Deportation / Removal  Proceedings

    Removal proceedings (formerly known as deportation and/or exclusion) can be instituted by the Department of Homeland Security against anyone who is not a U.S. citizen.  This covers those who have entered illegally, have overstayed their visa, are present in a currently valid visa status, and lawful permanent residents.

Grounds for Removal:

    Unlawful Presence - those present in the U.S. unlawfully, whether by illegal entry or overstay are removable.

    Criminal Convictions - Lawful Permanent Residents (as well as other nonimmigrants) may be subject to removal based upon certain criminal convictions.
